Commissioners Present: Jack Fitzsimmons (Chair), Ralph Shaw (Vice Chair), Jeff Cross, Lloyd Allen, John Rogers and Cass Costa.

Staff present: Drew McManus (Conservation Agent) and Melissa Brown (Board Secretary)

Jack Fitzsimmons called the meeting to order 6:55pm

Post Hearing Agenda:
   
1) 415 Monomoscoy, Enforcement Order (Approved landscape plan – Lisa Drake)
The agent described that the homeowners were issued a violation notice for removing a number of pitch pines from the property. He received no response to the violation and followed up by sending out an enforcement order. The agent did sit down with Christopher Joyce the landscaper hired by the applicant. The agent found the plans still to be inadequate to cover the concerns raised by the agent as well as the abutters. The abutters hired Michael Talbot (landscaper) who sat down with the agent and Mr. Joyce to hash out an adequate plan.  The subsequent plan has been approved and includes substantial migitative plantings, which consist of many types of native plants.

2) SE 43-2494 -- 96 Captain’s Row – Add pervious surface to end of driveway (Previously heard and closed on 10/04/2007)
The agent described that the changes to the driveway were recommended at the last meeting to help with any run off that may be created or currently exist. He presented the new plan to the Commission for review. It was found in good standing and will move forward with no additional approval needed.

3) Approve Minutes from 09/20/2007
   
 Motion made, seconded and unanimously carried to approve the minutes from 09/20/2007.

4) Cranberry Bogs
The agent informed the Commission that he would be meeting with Haley and Aldrich to go over the findings of the bog feasibility study on October 23, 2007.  After the all the information has been gathered the letters will be sent out to get bids from potential growers.

7:00 p.m. Michael and Judith Welch, AOC – 277 Monomoscoy Road (Continued from 09/20/2007)
The applicants have requested a continuance until 11/15/2007 @ 7:00 p.m.  The agent did inform the Commission that it is being continued due to the fact that the landscape layout has changed and needs an amended order.  

Motion made, seconded and unanimously carried for a continuance until 11/15/2007 @ 7:00 p.m.

7:03 p.m. Blanche Pozerski, AOC – 83 Whippoorwill Circle (Berth a 17’ Whaler)
(Cass Costa stepped down on this application.)
Mark Raymond (contractor) of Mark Raymond Survey and Associates represented the applicant and described the applicants wish to berth a 17’ Whaler at the existing pier. The request is to amend the original order that pertained only to the pier issued in August of 2007 under SE 43-2482. Mr. Raymond described that there is 24” clearance to the bottom of the river. The Whaler is currently garaged at the location. The agent stated that Rick York, the Shellfish Constable saw no impact on the shellfish as it is outside of the shellfish bed. The agent also noted that he had spoken to Perry Ellis, the Harbormaster and he saw no drafting issue or cause for concern from his prospective.
Motion made, seconded and unanimously carried to approve the amended order.

7:06 p.m. Trust of Cotuit Bay Condominium, NOI – 418 Quinaquissett Street, NOI  
(Removal of invasive vines)
The agent described the need for a continuance due to the applicant’s paperwork being filed incorrectly and the lack of proper documentation. The agent explained that a more definitive plan needed to be submitted and that oversight may be needed at the sight during removal of the vines. There has been a history of violations involving removal/ pruning of landscape without proper filing. No date was specifically requested for a continuance by the applicant, and the agent recommended continuing to 11/01/2007 @ 7:15 p.m.

Motion made, seconded and unanimously carried for a continuance until 11/01/07 @ 7:15 p.m.

7:09 p.m. Robert Manzi, RDA – 22 Neholden Road
(Construct screened porch onto an existing deck and expand the deck)
Tom Mackey (contractor) representing the applicant described the project. Mr. Mackey stated that the project would entail adding a screened porch on top of the existing deck while expanding the deck as well. The deck would extend over an existing pathway; the expansion does call for removal of three flowering bushes. The agent was not concerned with the removal of these bushes. The agent also noted that the property is on the outer reaches of the flood zone and is heavily landscaped. The agent felt that there would be no real impact and recommended approval.

Motion made, seconded and carried for a negative determination.

7:12 p.m. Frederic Blythe, NOI – 228 Wading Place (Continued from 10/04/07)
The applicant has requested a continuance until 1/10/2008 7:00 p.m. There are still some issues with the plans for the project and they will need to be updated to properly reflect the current landscape. The agent as well as Cass Costa noted that the area was not properly staked out during their on site visit. The stakes are needed so a clear picture of the layout can be established.

Motion made, seconded and unanimously carried for a continuance until 1/10/2008 @ 7:00 p.m.

7:15 p.m. Jeffrey Weisen, RDA – 30 Wheelhouse Lane (Continued from 10/04/07)
Mike Leblanc (contractor) from Leblanc Builders representing the applicant described the applicant’s wish to remove the current concrete pool deck and replace it with a new mahogany deck. The deck footprint will not change and all of the concrete removal will be done by hand. It will require no heavy machinery and have no adverse impact on the area. The agent agreed with this statement noting that the new decking will be an upgrade. The mahogany deck will remediate any run off that may exist or that may be created. The agent recommended approval.

Motion made, seconded and unanimously carried for a negative determination.  
 
7:18 p.m. John and Susan Costa, RDA – 105 Waterline Dr South (Add onto existing rear deck)
Robert Fox (contractor) of Robert Fox Builders representing the applicant described their request to add onto the existing rear deck. The addition would essentially be a ledge; the current deck is a triangle, and  
the addition would make it two rectangles. The area below the deck is currently pea stone and the new section will extend over an area of vegetation. The vegetation will not be harmed during construction. The addition will require 5 new sono tubes to be installed into the pea stone. The applicant will also be adding some plantings to the property. The agent determined at his on site visit that the area is pre-disturbed and the plans will be noninvasive. He recommended approval.

Motion made, seconded and unanimously carried for a negative determination.
